1. GENERAL INFORMATION

1. These regulations define the principles of the Store's operation, in particular, regulate the submission of orders for Goods by Customers, the method of delivery of these Goods, the form of payment, and the Customer's rights.
2. The Store provides services for the sale of Goods for which orders can be placed via the Internet via the website: https://mastwell.pl/sklep-online/
3. In order to use the Store's services, a computer or other device with Internet access is necessary.
4. The information about the Goods available on the Store's website (in particular the price) should be interpreted as an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.
5. Reading and accepting these regulations is a condition of using the Store.

2. DEFINITIONS

Order fulfillment time - the time in which the Store will complete the order and send it to be sent via courier to the address indicated by the Customer;
Working days - all days of the week from Monday to Friday, excluding public holidays;
Registration Form - a form available in the Store that allows you to create an Account;
Order Form - an electronic service, an interactive form available in the Store, enabling the addition of Goods to the Cart and defining the terms of the Sales Agreement, including the method of delivery and payment;
Password - a string of letters, numbers or other characters selected by the Customer during Registration in the Store, used to secure access to the Customer Account in the Store.
Client - (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity, or (2) a legal person or (3) an organizational unit without legal personality, which the law grants to legal - who has concluded or intends to conclude a Sales Agreement with the Seller.
Consumer - a natural person who performs a legal transaction with the entrepreneur not related directly to his business or professional activity;
Account - an account (electronic service) of the Store's Customer marked with a unique name (login) and password, being a collection of information about the Customer and his activities within the Store;
Cart - an element of the Store, by means of which the Customer specifies the details of the order, such as in particular: the number of Goods, delivery address, invoice data, delivery method, payment method, etc.
Regulations - these Store regulations;
Registration - the procedure for setting up a Customer Account, including in particular providing the Customer's contact details, carried out by completing the Registration Form;
Sklep – sklep internetowy działający pod adresem www.mastwell.pl, sprzedający Towary znajdujące się w jego ofercie za pośrednictwem Internetu, prowadzony przez Sprzedawcę;
Sprzedawca – Karolina Klukowska, prowadząca działalność gospodarczą pod firmą PHU MASTWELL POLSKA KAROLINA KLUKOWSKA, rolna 12, 1, 14-200 Iława, NIP 7441814209;
Goods - a product (a movable item) in the Store's offer, which is the subject of the Sales Agreement between the Customer and the Seller;
Sales contract - a contract for the sale of the Goods concluded between the Customer and the Seller via the Store;
Electronic service - a service provided electronically by the Seller to the Customer via the Store;
Order - Customer's declaration of intent submitted via the Order Form and aimed at concluding a Contract for the Sale of Goods with the Seller.. Search

3. GENERAL PROVISIONS

4. ELECTRONIC SERVICES IN THE STORE

1. The following Electronic Services are available in the Store: Account, Order Form.
1.1. Account - the use of the Account is possible after completing two consecutive steps by the Customer - (1) completing the Registration Form and (2) clicking the "Next" button. In the Registration Form, it is necessary for the Customer to provide the following data: name and surname, delivery address, telephone number, e-mail address and password. After the data is verified by the Store, the Customer Account is then activated and allows you to place Orders.
1.2.Usługa Elektroniczna Konto świadczona jest nieodpłatnie przez czas nieoznaczony. Klient ma możliwość, w każdej chwili i bez podania przyczyny, usunięcia Konta (rezygnacji z Konta) poprzez wysłanie stosownego żądania do Sprzedawcy, w szczególności za pośrednictwem poczty elektronicznej na adres: biuro@mastwell.pl
1.3. Order Form - the use of the Order Form begins when the Customer adds the first Good to the Basket in the Store. 1.4. In the Order Form, it is necessary for the Customer to provide the following data:
1.1.1. Type of order (selected product);
1.1.2. Customer's address and delivery address: provided during registration or other;
1.1.3. Shipping method: regular courier or cash on delivery;
1.3. Order Form - the use of the Order Form begins when the Customer adds the first Good to the Basket in the Store. 1.5. The Electronic Service Order Form is provided free of charge and is of a one-off nature and ends when the Order is placed through it or when the Customer ceases to place the Order earlier.

2. Technical requirements necessary for cooperation with the ICT system used by the Seller: (1) a computer, laptop or other multimedia device with Internet access; (2) access to electronic mail; (3) recommended web browser: Google Chrome 23.0. and higher; (4) the recommended minimum screen resolution: 1024 × 768; (5) enabling cookies and Javascript support in the web browser.
3. The Customer is obliged to use the Store in a manner consistent with the law and morality, with respect for personal rights as well as copyrights and intellectual property of the Seller and third parties. The customer is obliged to enter data in accordance with the facts.
4. Complaints related to the provision of Electronic Services by the Seller and other complaints related to the operation of the Store (excluding the Goods complaint procedure, which is indicated below), the Customer may submit, among others: in writing or by e-mail to the Seller's address.
5. The provision of: (1) information and circumstances relating to the subject of the complaint, in particular the type and date of the occurrence of irregularities, will help in quick consideration of the complaint; (2) Customer requests and contact details of the person submitting the complaint.
6. A response to the complaint takes place immediately, not later than within 14 calendar days from the date of its submission.

5. CONDITIONS FOR FULFILLING THE ORDER

1. Klient może składać zamówienia przez 24 godziny na dobę za pośrednictwem strony internetowej www.mastwell.pl. Realizacja zamówienia odbywa się w dniach: od poniedziałku do soboty w godzinach od 8.00 do 23.00; w niedzielę i święta w godzinach od 12.00 do 16.00, z wyjątkiem dni ustawowo wolnych od pracy. Sprzedawca zastrzega prawo do wyznaczenia dodatkowych dni zamknięcia Sklepu lub skrócenia godzin otwarcia po wcześniejszej informacji na witrynie Sklepu.

5. Dostawa Towaru następuje za pośrednictwem kuriera. Klient zostanie obciążony opłatą wynoszącą na dzień przyjęcia regulaminu 20 zł. Tutaj trzeba wyszczególnić:

    • Kurier 50-150 kg (przedpłata): 90 zł

    • Kurier 400-750 kg (przedpłata): 300 PLN
    • Kurier 750-1000 kg (przedpłata): 400 zł
    • Kurier > 1000 kg (przedpłata): 900 zł

6. PRICES OF GOODS
7. Pursuant to Art. 558 par. 1 of the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), the Seller's liability under the warranty for this sale has been excluded.
8. The delivery of the ordered goods will be made only if the ordered goods are available. If the Store does not have the Goods ordered by the Customer and the Goods will not be available within the time provided for the execution of the order, the Store will send the Customer a message to the e-mail address provided by the Customer with a request to make a decision on further proceedings regarding the order. In such a situation, the Customer may resign from the execution of the order in the part that cannot be fulfilled. At the customer's request, the store may extend the time of order fulfillment.
9. Regardless of the rights described above, in the absence of the Goods or inability to fulfill the Customer's order, the Store has the right to withdraw from the contract within 30 (thirty) days from the date of its conclusion. If the expected date of order fulfillment is longer than 30 (thirty) days, the Store has the right to withdraw from the contract within the period provided for the execution of the given order. If the payment for the Goods was made in advance, the Store will immediately refund the Customer the amount due for the goods in the same way as the payment was made.
10. At the latest when the Customer expresses his will to conclude a Sales Agreement, the Seller confirms to the Customer its terms by sending them to the Customer's e-mail address or in writing to the address provided by the Customer during Registration or placing an order. The terms of the contract include in particular: the description of the Goods being the subject of the Sales Agreement, its price, delivery costs and information on any other costs that the Customer is obliged to incur in connection with the Sales Agreement.
11. Towar zakupiony na specjalne zamówienie Klienta nie podlega zwrotowi.
12. Firma PHU MASTWELL POLSKA KAROLINA KLUKOWSKA realizuje zamówienia na czynnik R134A tylko na terenie Rzeczpospolitej Polski.
13. Pozostałe zamówienia międzynarodowe będą automatycznie anulowane.

6. PRICES OF GOODS

1. Sklep zamieszcza informacje na temat swojej oferty na stronie: www.mastwell.pl oferuje Towary.
2. Prices in the Store placed next to the offered Goods:
a) include VAT and are given in Polish zlotys;
b) do not contain information on shipping costs;
(c) do not contain information on possible customs duties.. Search

3. The binding and final price is the price of the product given on the Store's website at the time of placing the order by the Customer using the "Confirm order" button.
4. Information on the total value of the order is presented on the Store's website, after the Customer selects the method of delivery and payment method.
5. The Store reserves the right to make changes to the prices of the Goods on offer on an ongoing basis and to carry out and cancel all kinds of promotional campaigns and sales. The right referred to in the preceding sentence does not affect orders placed before the effective date of the price change, promotional campaign conditions or sales, which will be implemented on the basis of the existing rules.
6. Promotions in the Store cannot be combined, unless the regulations of a given promotion state otherwise. The Store is not responsible for the erroneous combination of two or more promotions as a result of an IT system error and is entitled to cancel such an order.

7. ORDER MODIFICATION

1. Zmian w zamówieniu można dokonać kontaktując się ze Sklepem za pośrednictwem poczty elektronicznej na adres: biuro@mastwell.pl pod warunkiem, że stan realizacji zamówienia na to pozwala, w szczególności, gdy zamówienie nie zostało jeszcze wysłane na wskazany przez Klienta adres dostawy.

a) resignation from the entire order or its part,
b) change the delivery address,

3. In the event of cancellation of the Order, if the payment for the Goods has been made in advance, the refund will be made within 14 (fourteen) days from the date of receipt of the Customer's resignation, to the Customer's bank account from which the payment was made.
If the Customer does not have a bank account, the amount will be refunded by postal order to the address indicated by the Customer.

8. FORMS OF PAYMENT AND BEGINNING OF ORDER COMPLETION

1. Payment for the Goods to be delivered in Poland can be made:
a) cash on delivery upon delivery,
b) by transfer to the bank account of the Online Store. The order will be processed after the Store receives confirmation of the correct payment execution,
c) Transfer via the PayU panel
2. Payment for the Goods to be delivered outside Poland can be made by bank transfer to the bank account indicated by the Store. The order will be processed after the Store receives confirmation of the correct payment.
3. The Customer may use the rebate code received from the Online Store.
4. The rebate codes are valid for the period of validity during which the customer can take advantage of the offered rebate. The rebate code cannot be combined with any other rebate code and other promotions, unless the terms and conditions of a given promotion indicate otherwise.
5. The provision of: (1) information and circumstances relating to the subject of the complaint, in particular the type and date of the occurrence of irregularities, will help in quick consideration of the complaint; (2) Customer requests and contact details of the person submitting the complaint.. 9. DELIVERY

1. The delivery of the Goods is payable, unless the Sales Agreement or these Regulations provide otherwise. The costs of delivery of the Goods (including fees for transport, delivery and transport services) are indicated to the Customer when placing the Order, including when the Customer expresses the will to be bound by the Sales Agreement.
2. For most of the Goods, the Store gives the order fulfillment time (in working days). The time of order fulfillment is given taking into account the date of completion of all ordered Goods.
3. The Customer is obliged to use the Store in a manner consistent with the law and morality, with respect for personal rights as well as copyrights and intellectual property of the Seller and third parties. The customer is obliged to enter data in accordance with the facts.

 

10. COMPLAINT

1. The Store delivers Goods without defects.
2. W przypadku gdy Towar ma wadę fizyczną lub prawną Klient ma prawo dochodzić uprawnień z rękojmi zgodnie z przepisami Kodeksu cywilnego, tj. Klient może;

11. RIGHT TO WITHDRAW FROM THE CONTRACT AND RULES OF RETURNING THE PURCHASED GOODS

The buyer-consumer who has concluded a sales contract with the Online Store may withdraw from it within 14 days without giving any reason and without incurring costs, except for the costs specified in art. 33, art. 34 sec. 2 and art. 35 of the Act of May 30, 2014 on consumer rights.
The deadline to withdraw from the contract referred to in point 1 shall expire after 14 days from the day on which the buyer-consumer acquires, or a third party, other than the carrier and indicated by the buyer-consumer, acquires physical possession of the goods.
Aby skorzystać z prawa odstąpienia od umowy, kupujący-konsument musi poinformować Sklep Internetowy o swojej decyzji o odstąpieniu od umowy sprzedaży, w drodze jednoznacznego oświadczenia (na przykład pismo wysłane pocztą na adres Sklepu Internetowego, lub pocztą elektroniczną na adres biuro@mastwell.pl). Oświadczenie o odstąpieniu od umowy może zostać złożone na formularzu, którego wzór stanowi Załącznik do Regulaminu, jednak nie jest to obowiązkowe.
In order to meet the deadline to withdraw from the contract, it is enough for the buyer-consumer to send information regarding the exercise of his right to withdraw from the contract before the deadline to withdraw from the contract.
In the event of withdrawal from the sales contract, the Online Store returns to the buyer-consumer all payments received from him, including the costs of delivering the item (except for additional costs resulting from the method of delivery chosen by the buyer-consumer other than the cheapest standard delivery method offered by the Online Store), immediately and in any case no later than 14 days from the date on which the Online Store was informed about the decision to exercise the right to withdraw from the contract.
The reimbursement will be made using the same payment methods that were used by the buyer-consumer in the original transaction, unless the buyer-consumer has expressly agreed to a different solution. In any event, the buyer-consumer will not incur any charges in connection with this return.
The Online Store may withhold the reimbursement until receipt of the item or until proof of its return is provided to him, depending on which event occurs first.
The buyer-consumer should send back or hand over the returned item to the address of the Store (please contact us by phone to determine the address of the return point) immediately, and in any case not later than 14 days from the day on which he informed the Online Store about the withdrawal from the contract. The deadline is met if the buyer-consumer returns the item before the expiry of the 14-day period.
In the event of withdrawal from the sales contract, the buyer-consumer bears only the direct costs of returning the item and is only responsible for reducing the value of the item resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the item.
The right to withdraw from a contract concluded outside the business premises or at a distance is not granted to the buyer-consumer in relation to contracts:
for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has fulfilled the service, he will lose the right to withdraw from the contract,
in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the contract,
in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individual needs,
in which the subject of the service is an item that deteriorates quickly or has a short shelf-life,
in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery,
in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items,
in which the subject of the service are alcoholic beverages, the price of which was agreed upon conclusion of the sales contract, and the delivery of which may take place only after 30 days and the value of which depends on fluctuations in the market over which the entrepreneur has no control,
in which the consumer expressly demanded that the entrepreneur came to him to make urgent repairs or maintenance; if the entrepreneur provides additional services other than those requested by the consumer, or provides items other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract with regard to additional services or items,
in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery,
for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement,
concluded through a public auction,
for the provision of accommodation services, other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract indicates the day or period of service provision,
for the delivery of digital content that is not recorded on a tangible medium, if the performance began with the consumer's express consent before the deadline to withdraw from the contract and after informing the entrepreneur about the loss of the right to withdraw from the contract.

In the event of a need to return funds for a transaction made by the customer with the card
the payment seller made a refund to the bank account assigned to the payment card of the Ordering Party.

12. RULES OF PROCESSING PERSONAL DATA OF THE BUYERS

Złożenie zamówienia w Sklepie Internetowym jest równoznaczne z wyrażeniem zgody na przetwarzanie przez mastwell.pl danych osobowych zawartych w zamówieniu w celu określonym w pkt 3, zgodnie z przepisami ustawy z dnia 29.08.1997 r. o ochronie danych osobowych.

Mastwell.pl jest uczestnikiem organizowanego przez spółkę Ceneo Sp. z o.o. z siedzibą w Poznaniu, ul. Grunwaldzka 182 w ramach serwisu Ceneo.pl programu “Zaufane opinie”. Z tego względu Kupujący może wyrazić zgodę na przekazanie przez mastwell.pl jego adresu e-mail oraz numeru zamówienia spółce Ceneo Sp. z o.o. oraz na przetwarzanie przez mastwell.pl oraz Ceneo Sp. z o.o. przekazanych danych osobowych Kupującego dla potrzeb wypełnienia ankiety dotyczącej opinii na temat transakcji zrealizowanej w Sklepie Internetowym.
Mastwell.pl przekazuje dane osobowe Kupujących, dokonujących płatności przelewem elektronicznym lub kartą płatniczą firmie PHU Mastwell Polska Karolina Klukowska z siedzibą w Iławie, ul. Rolna 12 wpisanej do Centralnej Ewidencji i Informacji o Działalności Gospodarczej pod numerem regon 365535630. Przekazanie dotyczy danych osobowych niezbędnych do zrealizowania przez Mastwell Polska procesu płatności, która w zakresie tych danych staje się ich administratorem.
